Terms of Service

1. Website owner, offering, and binding of Terms

This website is owned and operated by Laura Wakefield | Joyfulicity. These Terms set forth the terms and conditions under which you may use our website and services as offer by us. This website offers visitors access to The Joyfulicity Podcast and various links to its social platforms, access to books written by Laura Wakefield via link to Amazon, and access to the Joyfulicity store with the ability to purchase products through the site. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these terms.

 

2. Who can use our website

In order to use our website and/or receive our products or services, you must be at least (thirteen) years of age, or of legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as binding agreement. You are not allowed to use this website and/or receive products or services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

3. Key commercial Terms offered to customers

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using/purchasing our services/products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

The fee for the services/products and any other charges you may incur in connection with the use of our website, such as taxes and possible transaction fees, will be charges at the time of purchase to your payment method.

 

4. Return and refund policy

(i) What’s your return policy?


We don’t offer returns and exchanges, but if there’s something wrong with your order, please let us know by contacting us at info@joyfulicity.com
     
(ii) Do you offer refunds?


Refunds are only offered to customers that receive the wrong items or damaged items. If any of these apply, please contact us at info@joyfulicity.com with photos of wrong or damaged items and we’ll sort that out for you.


(iii) Can I exchange an item for a different size/color?

At this time, we don't offer exchanges. Though rare, it's possible that an item you ordered was mislabelled. If that’s the case, please let us know at info@joyfulicity.com within a week after receiving your order. Include your order number and photos of the mislabeled item, and we’ll send you a new one, or issue a refund.

 

5. Shipment, Fulfillment or Delivery Policy

 

(i) When will I get my order?

Usually, it takes 3–7 days to fulfill an order, after which it’s shipped out. The shipping time depends on your location, but can be estimated as follows:

• USA: 3-4 business days

• Europe: 6-8 business days

• Australia: 2-14 business days

• Japan: 4-8 business days

• International: 10-20 business days

 

(ii) Where will my order ship from?

We work with an on-demand order fulfillment company with facilities worldwide!


(iii) Will I be charged customs for my order?

​

An additional customs and tax fee can occur on international orders. This fee is not in our control and is assessed by your local customs office. Customs policies vary widely for every country so please check with your local customs office directly to see if they apply duties and taxes to your purchases.


(iv) My order should be here by now, but I still don't have it. What should I do?

Before getting in touch with us, please help us out by doing the following:

• Check your shipping confirmation email for any mistakes in the delivery address

• Ask your local post office if they have your package

• Stop by your neighbors in case the courier left the package with them


If the shipping address was correct, and the package wasn't left at the post office or at your neighbor’s, get in touch with us at info@joyfulicity.com with your order number within one week of estimated delivery time. If you did find a mistake in your delivery address, we can send you a replacement order, but shipping will be at your own cost.

 

6. Orders


(I) How are your products made?


We work with a print-on-demand drop shipper. They have locations worldwide, so depending on where you are, your orders are printed and shipped from the facility that can do it most efficiently.


(ii) How do I track my order?


You’ll receive a tracking link via email when your order ships out. If you have any questions about your tracking or shipment, drop us a line at info@joyfulicity.com


(iii) I received a wrong/damaged product, what should I do?


We’re so sorry if the product you ordered arrived damaged. To help us resolve this for you quickly, please email us  at  info@joyfulicity.com within a weeks' time with photos of the damaged product, your order number, and any other details you may have about your order. We’ll get back to you with a resolution as soon as possible!

 


7. Retention of right to change offering

We may, without prior notice, change the services/products; stop providing the services/products or any feature of the services/products we offer; or create limits for the services/products. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

8. Ownership of intellectual property, copyrights and logos

 

The service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are exclusive property of Laura Wakefield | Joyfulicity. Except as explicit provided herein, nothing in there Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, adapt, edit or create derivative works thereof.

 

9. Right to suspend or cancel user account

 

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time.

 

10. Indemnification

 

You agree to indemnify and hold Laura Wakefield | Joyfulicity harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services/products offered on the website.

 

11. Limitation of liability

 

To the maximum extent permitted by applicable law, in no event shall Laura Wakefield | Joyfulicity, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Laura Wakefield | Joyfulicity assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our services and products; and (iii) any unauthorized to or use of our (Wix's) secure servers and/or any and all personal information stored therein.

 

12. Right to change and modify Terms

 

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that the material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us (including your phone number for calls or text messages). If you don’t want to receive such promotional materials or notices - please just notify us at any time.

 

14. Preference of law and dispute resolution

 

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services/products, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of United States of America / Tennessee, without respect to its conflict of law principles. Any and all such claims and disputes shall be brought in, and hereby consent to them being decided exclusively by a court of competent jurisdiction located in Nashville. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
